GENERAL TERMS AND CONDITIONS OF USE

Forenseek is a Website designed to provide expert assistance in the field of forensic entomology.
The Forenseek Website is currently a test version.
The Website and service are free.
Users are able to send reports of bugs and problems encountered when using the Website.
Article 1: Definitions:
Administrator: The Site administration is entrusted to Université Lille II [a French university for health, sports, management and law], located at Lille, France and the Unité de Taphonomie Médico-Légale de Lille [the French Forensic Taphonomy Unit], represented by Damien Charabidze.
User: The "User" is any person who uses the Site or one of the free services offered on the Site.
GTCU: The acronym "GTCU" refers to these General Terms and Conditions of Use.
User Content: The term "User Content" refers to data transmitted by the User in the various sections of the Site.
Member: The term "Member" refers to a User who is identified on the Site.
User ID: The term "User ID" covers the information required to identify a User on the Site to access areas restricted to Members.
Password: The term "Password" refers to confidential information, which the User must keep secret, which allows him to prove his identity when used in conjunction with his User ID.
Service: The term "Service" refers to the availability of the service(s) of the Site.
Site: The term "Site" refers to the Forenseek Site available at: www.forenseek.org.
Article 2: Objective:
These General Terms and Conditions of Use are intended to define the terms of provision of the Service of the Forenseek Site and the conditions of use of the Service by the User.
All access and/or use of the Forenseek Site assumes the unconditional acceptance of and compliance with all of the terms of these GTCU.
In the event that the User does not wish to accept all or part of these GTCU, he will be asked to refrain from all use of the Service.

Article 4: Access to the Service:
The Service is available free to any User with access to the Internet.
All costs associated with access to the Service, whether these are costs related to hardware, software or Internet access, are exclusively the responsibility of the User. He is solely responsible for the proper functioning of his computer equipment as well as his Internet access.
All sections of the Site are reserved for Members who have identified themselves by using their User ID and Password.
The Site Administrator reserves the right to refuse access to the Service, unilaterally and without prior notice, to any User who fails to comply with these GTCU.
The Site Administrator implements all reasonable means at its disposal to ensure quality service.
The obligation on the part of the Administrator is only an obligation with regard to the means used.
The Administrator cannot also be held responsible for any malfunction of the network or servers or any other event beyond his reasonable control which would prevent or degrade access to the Service.
The Administrator reserves the right to interrupt, temporarily suspend or modify, without prior notice, access to all or part of the Service, in order to ensure maintenance, or for any other reason, without the interruption constituting entitlement to any obligation or compensation.
Users are expected to send reports of bugs and malfunctions encountered when using the Site, and this is with a view to improvement of the said Site.
Article 5: Rights of Use:
The right to use the Site and its software is granted to the User on a personal and non-transferable basis for the purposes of consultation of results published on the Site.
In any event, the author of the Site retains a right of ownership to the software which the User undertakes to respect.
Article 6: Intellectual Property:
The Site logo is protected by copyright.
Any unauthorised reproduction of this logo constitutes a violation punishable by law.
The scientific data available for free consultation are public, free and therefore free of copyright.
The User can choose to publish the results of the study he has commissioned online on the Site or keep them secret for his own personal information.
In the event that he chooses to publish these results, they would fall into the public domain and would be accessible to any User of the Site.
The User would then forfeit all said intellectual property rights.
Any publishing of results online will be subject to prior validation by the Administrator.
Article 7: User Content:
The User is solely responsible for the User Content he publishes online through the Service.
He undertakes in particular to ensure that the data, whatever it may be, does not undermine the legitimate interests of third parties of any kind.
In this respect, he guarantees the Administrator of the Site against all actions based directly or indirectly on these words and/or data, likely to be instituted by any person against the Administrator of the Site, including attorney’s fees and court costs.
The Administrator reserves the right to delete all or part of the User Content, at any time and for any reason whatsoever, without warning or prior justification. The User may assert no claim in this regard.
In accordance with the French Data Protection Act of 6 January 1978, the User has a right of access and rectification of the data concerning him and he can exercise this right by sending a letter to the following address: Institut Médico-Légal, Université Lille 2 – Damien CHARABIDZE – Rue André VERHAEGHE – F-59000 LILLE – FRANCE ; or by sending an email to the following email address: contact at forenseek dot org.
This automated processing of personal information was the subject of a declaration to the CNIL [Commission Nationale de l’Informatique et des Libertés/French data protection authority] under number 1757479.
Article 8: Limits of Liability:
The version of the Site is currently a test version and may contain bugs and malfunctions, without, however, constituting a liability on the part of the Administrator.
The use of information and content available throughout the Site shall in no way constitute a liability on the part of the Administrator in any capacity whatsoever. The User alone is responsible for the proper and judicious use of the information provided on the Site.
Access to certain sections of the Site requires the use of a User ID and a Password. The Password chosen by the User is personal and confidential.
The User undertakes to keep his Password secret and not to disclose it in any form whatsoever. The use of his User ID and Password on the internet is at the risk of the User.
The User undertakes to take all necessary measures to protect his personal data against any attack.
The Site Administrator nevertheless undertakes to implement all the reasonable means necessary to ensure the security and confidentiality of the data transmitted.
The Administrator cannot under any circumstances, within the scope of the applicable law, be held liable for damage and/or injury, direct or indirect, material or immaterial, or of any kind whatsoever, resulting from unavailability of the Service or any Use of the Service.
Article 9: Guarantees:
The knowledge, results and information received by the User within the context of the execution of these GTCU are communicated as is, without guarantees of any kind whatsoever given by the Administrator.
Article 10: Force Majeure:
Events of force majeure are those deemed independent, unpredictable and irresistible and for which the parties shall not be held liable.
The following are in particular considered as events of force majeure: strikes, acts of terrorism, wars, problems relating to suppliers, transport or production, exchange rate fluctuations, acts of public authorities and natural disasters.
Also expressly considered to be events of force majeure are those regularly upheld by French court jurisprudence and tribunals.
Article 11: Competent Court:
Any dispute relating to the interpretation and implementation of these GTCU is subject to French law.
Failing amicable resolution, the dispute will be brought before the competent courts.
